Terms Of Use
These Terms of Use (“Terms”) govern your access to and use of DrotoBay.com (the “Website”) and the DrotoBay mobile application (collectively, “DrotoBay”). DrotoBay Technology, LLC (“DrotoBay,” “we,” “us,” or “our”) provides a platform for drone pilots (“Pilots”) to list services and for clients (“Clients”) to purchase those services. By using DrotoBay, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use DrotoBay.
1. General Terms
By accessing or using DrotoBay, you represent that you are at least 18 years old, or between 13 and 18 with the consent of a parent or legal guardian. You also agree to provide accurate and current information when registering for an account.
We may change these Terms from time to time, and by continuing to use DrotoBay after such changes, you accept the updated Terms.
2. Definitions
- Users: Individuals or entities using DrotoBay.
- Clients: Users who purchase services on DrotoBay.
- Pilots: Users who list and offer services for sale on DrotoBay.
- Orders: Formal agreements between Clients and Pilots initiated through the Website.
- Completed Order: An order that has been delivered by the Pilot and accepted by the Client or automatically marked complete after three days without Client action.
- Resolution Center: A tool for resolving disputes between Clients and Pilots.
3. Use of DrotoBay
Account Creation and Responsibilities
You must register for an account to use DrotoBay’s services. You are responsible for all activities that occur under your account and for keeping your account password secure.
Prohibited Actions
You may not:
- Create multiple accounts.
- Engage in fraudulent or unlawful activity.
- Offer or accept payments outside DrotoBay.
- Post or distribute inappropriate, offensive, or illegal content.
Violation of these or any other Terms may result in account suspension or termination.
4. Orders and Payments
Order Creation
Clients initiate orders by purchasing services listed by Pilots or through Custom Offers. DrotoBay holds Client payments until the order is marked as complete.
Order Completion
An order is considered complete when:
- The Client accepts the delivered work, or
- No request for modification is made within three days after the Pilot delivers the work.
Cancellations
- Clients can request a cancellation by asking the Pilot to cancel the order. If the Pilot refuses, the Client may open a dispute through the Resolution Center.
- Pilots who fail to deliver on three consecutive orders will have their account suspended, and their listings will be removed.
Refunds
Refunds can be requested only for canceled orders before completion. Once an order is completed, refund requests must be resolved through direct communication with the Pilot or via the Resolution Center.
5. Order Disputes and Resolution
Dispute Process
Clients have three days from the date an order is marked complete to open a dispute through the Resolution Center. Disputes should first be handled by direct communication between the Client and the Pilot. If the issue cannot be resolved, the Client may escalate the matter to the Resolution Center for mediation.
Resolution Center
DrotoBay encourages Clients and Pilots to resolve issues independently. However, the Resolution Center is available for unresolved disputes, and the outcome will be determined by DrotoBay support.
6. Pilot Responsibilities
Service Fulfillment
Pilots must fulfill orders according to the terms of their listing. Failing to meet delivery deadlines may result in cancellation and negative impact on the Pilot’s status.
Account Suspension
If a Pilot cancels or fails to fulfill three consecutive orders, their account will be suspended, and their listings removed.
Content Ownership
Pilots are responsible for ensuring that their listings and services do not infringe any third-party intellectual property rights. DrotoBay retains the right to use published delivered works for marketing and promotion purposes.
7. Reviews
Clients may leave feedback after an order is completed. Feedback must be based on legitimate sales and will be publicly displayed on the Pilot’s listing page. Pilots may not solicit or manipulate reviews.
8. Payment Terms
DrotoBay will charge a 7% service fee to the Client on all orders, including tips. This fee is applied at checkout and will be clearly displayed before the order is confirmed.
Pilots will receive the full amount paid by the Client (excluding the 7% service fee) once the order is marked complete. Payments to Pilots will be made through the selected payment method (e.g., PayPal, Venmo) within 48 hours of requesting a payout.
9. Intellectual Property and Content
Ownership
All content on DrotoBay, including text, graphics, logos, and software, is the property of DrotoBay or its licensors and is protected by intellectual property laws. Users may not duplicate, copy, or re-use any part of the Website without prior written permission.
User Content
By posting content on DrotoBay, Pilots grant DrotoBay the right to use, modify, and promote that content for marketing purposes. Pilots warrant that they hold valid licenses for any media used in their listings.
10. Termination and Suspension
DrotoBay may terminate or suspend your account at any time for violation of these Terms or if we believe your actions are harmful to other Users or to DrotoBay. If your account is suspended, your access to DrotoBay’s services will be revoked, and your listings will be removed from the platform.
11. Limitation of Liability
DrotoBay provides the platform for connecting Clients and Pilots, but we do not guarantee the quality or timeliness of services provided. DrotoBay is not responsible for any damages, losses, or disputes that arise from the use of the platform.
12. Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes arising from the use of DrotoBay will be resolved in the courts located in Idaho.
